We are currently residing in the United States under the following circumstances:
- My current status: L1B visa holder
- My dependents: Wife and child, both L2 visa holders
- Our current visa expiry date: 8 April 2025
- Our current I-94 expiry date: 23 May 2025
Recent developments and upcoming travel: 1. My employer has applied for a two-year extension of my L1B status via Form I-129, which has been approved (I-797 approval notice in hand). 2. For my dependents, Form I-539 has been filed for L2 status extension, which is currently pending. 3. My wife and child need to travel to India from February 2025 until April 2025.
Given this situation, I have three primary questions:
Visa Renewal Eligibility: Can my dependents apply for L2 visa renewal appointments concurrently with my L1B renewal, based on my approved L1B extension, despite their pending I-539? I have both the I-539 receipt and my approved I-797.
