Son of small business owner is taking tips

I work a job with good hours and fine pay. The real gravy is the generosity of customers. The tips can range from 2-8 dollars an hour depending on the season. The business isn't super successful, and I've determined that I walk away with a higher pay than the boss and the son most days. I'm sympathetic to that, but that's really not my fault or my problem. A lot of times he's working for free, because he can only make a certain amount because of his insurance. This, for some reason, makes it fair for him to take tips from the pool, even though his mommy can write him a check at any time for anything he wants (with the value my coworkers and I generate).

Publicly, the son and boss say he's the co-owner. Privately, my boss says because he holds no equity, he's not an owner. It feels like he's straddling the line to get a piece of the pie from both sides.

Over Christmas, we made a substantial amount in the cash tip pool. Upon seeing that, he told my boss it was a "mistake" that he was taken out of the cash tip jar. Honestly, the day he touches that is the day I quit.

I don't want to rock the boat too hard, but it gets to me more and more every day. Still beats out other jobs, at least. Wish there was a way for me to quietly report this to the DOL, but I'd certainly be discovered.
